Copyright and Takedown Policy
This Policy explains how copyright owners can report material, how uploaders can respond, and how ZynkWatch may handle copyright complaints.
1. Respecting copyright
Copyright may protect videos, films, television programs, music, sound recordings, photographs, illustrations, artwork, writing, software, courses, broadcasts, and other original works.
Users are responsible for obtaining every permission, license, or legal right needed to upload, display, edit, perform, distribute, or otherwise use material on ZynkWatch.
Copyright rules can include exceptions or limitations such as quotation, criticism, review, reporting, education, parody, or fair use. These rules depend on the law and the facts. ZynkWatch cannot provide personal legal advice about whether a particular upload is lawful.
2. Before submitting a complaint
A complainant should confirm that they own the copyright or are authorized to act for the owner.
Before reporting, consider whether:
- the uploader has permission or a license;
- the material belongs to the person being reported;
- the use may be allowed by a legal exception or limitation;
- the complaint identifies the correct ZynkWatch content;
- a trademark, privacy, impersonation, or harassment report would be more appropriate.
3. Information required in a copyright complaint
To help ZynkWatch identify and evaluate the complaint, the notice should include all of the following:
- The physical or electronic signature of the copyright owner or a person authorized to act for the owner.
- Identification of the copyrighted work claimed to have been infringed. For multiple works, provide a clear representative list.
- Identification of the allegedly infringing material and enough information for ZynkWatch to locate it, including the complete ZynkWatch URL whenever possible.
- The complainant’s full name, organization if applicable, mailing address, telephone number, and a monitored email address.
- A statement that the complainant has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and that the complainant is the copyright owner or is authorized to act for the owner.
- For a notice submitted under United States DMCA procedures, the required statement under penalty of perjury.
Screenshots, registration information, original publication details, licenses, or other supporting evidence may help, but they do not replace the required information above.
4. How to submit a complaint
Submit the complaint through the Contact and Report Abuse page. Include “Copyright Complaint” in the subject or first line and provide all information listed in this Policy.
Incomplete notices may be returned for clarification or may not provide enough information for ZynkWatch to locate or evaluate the material.
5. What ZynkWatch may do after receiving a complaint
ZynkWatch may review the notice, the identified material, account records, available ownership information, relevant context, and any response from the uploader.
ZynkWatch may:
- ask the complainant for missing or clearer information;
- ask the uploader for permission or ownership evidence;
- temporarily restrict or disable access to the material;
- remove the material;
- decline action where the notice is invalid, incomplete, or clearly mistaken;
- preserve relevant records for security, dispute, or legal purposes;
- apply account or channel enforcement for repeated or serious infringement.
Where an applicable notice-and-takedown law requires expeditious removal or disabling of access, ZynkWatch will aim to act without unreasonable delay after receiving a legally sufficient notice.
6. Notice to the uploader
When content is removed or disabled because of a copyright complaint, ZynkWatch may notify the uploader and provide information reasonably necessary to understand the action.
A complaint may be shared with the uploader, the copyright owner, legal representatives, service providers, courts, or authorities where reasonably necessary to process the dispute, comply with law, or protect rights.
Personal contact information may be redacted when appropriate, but ZynkWatch cannot promise anonymity in a legal copyright process.
7. Counter-notification by the uploader
An uploader who believes material was removed because of a mistake or misidentification may submit a counter-notification.
A counter-notification should include:
- The uploader’s physical or electronic signature.
- Identification of the material removed or disabled and the location where it appeared before removal.
- A statement, made in good faith, explaining why the material was removed because of mistake or misidentification.
- The uploader’s full name, mailing address, telephone number, and monitored email address.
- Any permission, license, ownership, public-domain, or legal-exception information supporting restoration.
- Where the counter-notification relies on United States DMCA procedures, the legally required statements under penalty of perjury, consent to the applicable federal court jurisdiction, and acceptance of service of process from the complainant.
ZynkWatch may request additional information before processing an incomplete counter-notification.
8. Possible restoration of content
ZynkWatch may send a valid counter-notification to the original complainant. Where applicable US DMCA rules govern, content may be restored after the legally specified waiting period unless the complainant informs ZynkWatch that a court action has been filed seeking to restrain the uploader’s activity.
Outside that process, ZynkWatch may restore, continue to restrict, or permanently remove content after considering the notices, evidence, applicable law, safety issues, and the Terms of Service.
Restoration under a copyright process does not prevent separate removal under the Community Guidelines, privacy rules, court orders, or other legal requirements.
9. Repeat and serious infringement
ZynkWatch may record valid copyright complaints and apply a repeat-infringer policy in appropriate circumstances.
Depending on severity, evidence, and history, ZynkWatch may remove videos, limit uploads, restrict channels, suspend accounts, or permanently terminate accounts.
ZynkWatch may distinguish between valid complaints, retracted complaints, restored material, mistaken notices, and unresolved disputes when evaluating an account’s history.
10. False, abusive, or fraudulent claims
Do not knowingly make a false copyright complaint or counter-notification. Misrepresentations may cause legal liability and may lead to restriction of the reporting or user account.
ZynkWatch may reject or investigate notices used for harassment, censorship, fraud, impersonation, competitive abuse, or attempts to obtain private information.
11. Records, preservation, and disclosure
ZynkWatch may retain complaints, counter-notifications, correspondence, account identifiers, content metadata, enforcement history, and related technical records for as long as reasonably needed to resolve disputes, prevent abuse, enforce repeat-infringer rules, comply with law, or establish and defend legal claims.
Removed files may remain temporarily in protected backups until overwritten under normal backup cycles, but should not remain publicly accessible merely because a backup exists.
12. United States DMCA designated-agent status
ZynkWatch is operated from Pakistan and copyright disputes may be governed by Pakistan’s Copyright Ordinance, 1962, other applicable law, or the law of the relevant jurisdiction.
A user-content service seeking the safe-harbor protections of section 512 of the United States Digital Millennium Copyright Act must satisfy additional conditions. These include publicly displaying designated-agent contact information and registering matching information in the US Copyright Office’s electronic directory.
13. Copyright contact
Use the Contact page for copyright complaints and responses. Provide a monitored email address so ZynkWatch can request clarification or respond. Do not send a copyright complaint to an unattended or no-reply mailbox.
Copyright complaints and responses can currently be submitted through the Contact and Report Abuse page. Include the information required by the relevant complaint or counter-notification section above.
